These terms

These terms apply to your use of our website. By using the website, you agree to them. If you do not agree, please do not use the website.

These terms do not govern the services we provide. If you instruct us as a landlord, vendor, buyer or investor, or apply for a tenancy, our services will be provided under a separate written agreement, such as our terms of business, management agreement or tenancy agreement. If there is any conflict between those documents and these terms, the separate agreement will apply.

Our services

We provide lettings, property management, residential sales, property sourcing, and acquisitions and disposals services. Details of each service, including what is included and what it costs, will be set out before you instruct us.

Fees

Our fees are published on our website and will be confirmed in writing before you instruct us. All fees are shown inclusive of VAT where applicable.

Tenants: in line with the Tenant Fees Act 2019, we do not charge tenants any fees other than those permitted by law, such as rent, a tenancy deposit, a holding deposit, and certain default fees set out in the tenancy agreement.

Property information

We take care to make sure property details on our website are accurate and include the material information you need to make an informed decision. However, details such as measurements, floor plans, photographs and descriptions are for guidance only and do not form part of any contract. Properties may no longer be available, and prices and rents may change. You should verify any information that is important to you, and we recommend you obtain an independent survey and legal advice before committing to a purchase or tenancy.

Not financial or investment advice

Any market insights, yield figures, projections, deal analysis or investment opportunities on our website or in our communications are general information only. They are not financial, investment, tax or legal advice, and they do not take your personal circumstances into account. We are not authorised or regulated by the Financial Conduct Authority. Property values and rental income can go down as well as up, and past performance is not a guide to future returns. You should take independent professional advice before making any investment decision.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these terms affects your statutory rights.

Subject to this, we are not liable for any loss arising from your use of, or reliance on, the website or its content, including decisions made on the basis of general information, market insights or investment opportunities. We do not guarantee the outcome of any sale, letting or investment. Our liability in relation to our services will be set out in the separate agreement that applies to them.

We handle your personal information in line with our Privacy Policy, which explains what we collect, why, and your rights. Non-essential cookies are only used with your consent through our cookie banner.

Complaints

If you are unhappy with our service, please contact us at info@berbergroup.co.uk so we can try to resolve it. Our complaints procedure is available on request. If we cannot resolve your complaint, you can refer it to the Property Redress Scheme, usually within 12 months of our final response.

Ending your use of the website

We may suspend or restrict your access to the website if you breach these terms or use the website unlawfully. Ending a service agreement with us will be handled in line with the notice terms in that agreement.

Changes to these terms

We may update these terms from time to time. The latest version will always be available on our website, with the date it was last updated shown at the top. Changes will not affect any service agreement you have already entered into with us.

If any part of these terms is found to be invalid or unenforceable, the rest will remain in effect. If we do not enforce any of these terms straight away, we can still enforce them later.

Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
